Terms and Conditions for participating in the Remote IQOS Lending Program
1. Application of Terms/Eligibility
1.1 These terms and conditions (Terms) are applicable to and govern your participation in the Remote IQOS Lending Program (IQOS Lending). You should read these Terms carefully as they affect your legal rights and govern your relationship with Philip Morris (Philip Morris ApS, Copenhagen Towers, Ørestads Boulevard 108, 3 sal, 2300 København S, Denmark).
1.2 IQOS Lending offers the user option to try IQOS paying a handling fee of 19 DKK. for the purposes of getting to know how to use IQOS before you may decide or not to purchase the IQOS device that they received.
1.3 You are only eligible for the IQOS Lending if: (i) you are an adult smoker or IQOS user aged 18 years and over and you are registered in our IQOS database; and (ii) your main residence is in Denmark.
1.4 To participate in IQOS Lending you must register in our database at iqos.com.
1.5 By signing up for IQOS Lending on iqos.com, clicking ‘I Agree’ or a similar button, you agree to be bound by these Terms. Your acceptance of these Terms is deemed to occur in Denmark.
1.6 If you do not agree (or cannot comply) with these Terms, then you are not permitted to use IQOS Lending.
1.7 No modification of these Terms by you is permitted unless Philip Morris expressly agrees in writing.
1.8 Philip Morris reserves the right to terminate your right to use IQOS Lending if you breach any of the Terms
1.9 We also reserve the right to amend these Terms and IQOS Lending upon notice at any time. If you do not agree to any such amendments you may terminate your participation in IQOS Lending.
1.10 In completing the registration process you must provide all required mandatory information in an accurate and complete manner and keep this information up-to-date. If you do not complete the mandatory fields in the application form (such as, for example, age, smoker status, email address and/or phone number, shipping address, credit card details) your application will not proceed. If you provide inaccurate or incomplete information Philip Morris reserves the right to terminate your membership of IQOS Lending without notice.
1.11 Following the registration process for IQOS Lending you will be informed whether your registration is successful. Participation in IQOS Lending entitles you to the services described in paragraphs 2 (Services).
1.12 Membership of IQOS Lending and the Services provided are personal to you and may not be transferred to any third party.
2. Payment Terms
2.1 To participate In IQOS Lending you must register and pay a handling fee of 19 DKK.
2.2 In order to validate your card information and guarantee your participation to IQOS Lending, the credit card information you provided when paying the handling fee will be stored and processed by our CPI-certified payment provider PayNext. PayNext handles all data encrypted (SSL) and your data is not accessible to external parties.
Credit card information will be stored for a maximum of 30 days.
2.3 If you wish to keep IQOS at the end of the IQOS Lending Program, the final amount (see below) will be debited from the credit card you provided for the registration and payment of the handling fee.
3.1 IQOS Lending. Based on your expressed interest in converting from cigarettes to IQOS and for the purposes of getting to know how to use IQOS before you may decide or not to purchase the IQOS device, Philip Morris will provide you with an IQOS 2.4+ Charger, IQOS 2.4+ Holder, AC power adaptor, USB cable, cleaner, the user guide, support materials to guide you through the trial period (IQOS). You can choose the white or navy color of IQOS.
After you register to the IQOS Lending, Philip Morris will send you IQOS within 3 business days and you can use IQOS within 10 calendar days (Lending Period) from the date of receipt of IQOS.
Remote IQOS Expert. You will have access to a dedicated remote IQOS Expert for supporting you in converting from cigarettes to IQOS during the Lending Period. Access is during normal business hours in your country of residence. You agree to be contacted by email, SMS or phone call during the Lending Period for commercial purposes.
If you wish to keep IQOS at the end of your Lending Period you can purchase it by contacting customer service center or your assigned IQOS Expert. The amount of 480 DKK will be debited from the credit card you provided for the registration.
If you do not wish to keep IQOS at the end of your Lending Period, you are obligated to return it. Please contact the customer service center or your assigned IQOS Expert to organize the return.
If you do not return IQOS within 10 calendar days post Lending Period, an amount of 480 DKK will be debited from the credit card you provided for the registration. In such case, Philip Morris is allowed to contact you after the Lending Period.
4.1 You may terminate your participation in IQOS Lending at any time with immediate effect by notifying Philip Morris, contacting the customer service center or your assigned IQOS Expert. Upon termination of your participation you are no longer entitled to receive the services and you will be obligated to return the IQOS back and the paid handling fee of 19 DKK shall not be reimbursed.
4.2 Philip Morris may terminate your participation in IQOS Lending at any time with immediate effect if you breach these Terms. Philip Morris may also terminate your participation for any reason upon 30 days’ notice.
5. Your Obligations
(a) to take all reasonable precautions to protect IQOS and use and maintain it in accordance with its instructions and user guide;
(b) not to misuse the IQOS Lending program and the Services;
(c) to use IQOS in accordance with the Terms;
(d) to compensate Philip Morris 480 DKK in case of any damage to IQOS due to non-compliance with the Terms, for example,
(i) damage caused by abuse or misuse, or actual, or attempted, modification or alteration of IQOS, power surge;
(ii) a serial number that has been altered, defaced or removed;
(iii) IQOS that have been opened, serviced, modified or altered in a manner not authorized by Philip Morris;
(iv) the loss or theft of IQOS, or damage from fire, flood;
(v) cosmetic damage to IQOS which does not affect its functionality, including, but not limited to, hairline cracks, scratches, dents, broken plastic on ports and discoloration;
(vi) malfunction due to use with non-compatible product;
(vii) damage or malfunction caused by failure to use as described in the associated IQOS User Guide.
(e) to comply with applicable law;
(f) to return IQOS in case you decide not to purchase the product.
6.1 As your membership of IQOS Lending is provided ‘As Is’ and without any warranty.
6.2 Philip Morris ApS assumes no liability for possible damage, including loss of profit, data loss, business interruptions and all other damage of any nature, that could result from the use of Websites and/or Apps and their content as well as, in particular, the usage of documents and/or Apps contained therein. Philip Morris ApS also assumes no liability for possible damage that could arise due to fact that it is not possible to purchase or delivery items or Products that are related with Websites and/or Apps.
6.3 Nothing in this paragraph 6 excludes any liability that cannot be excluded by applicable law.

These Terms are subject to the laws of
the registered office of Philip Morris. Any legal dispute will be subject to
the exclusive jurisdiction of the city in which Philip Morris has its
