Rental terms

Scope
- These terms and conditions are applicable to and govern your rental of devices for heating tobacco. You should read these terms carefully as they affect your legal rights and govern your relationship with Philip Morris ApS, CVR Number 25797922, Ørestads Boulevard 108, 3. 2300 København S, Denmark (Philip Morris).
- You are only eligible for renting a device if: (i) you are an adult smoker aged 18 years and older and (ii) you reside in Denmark. You are not allowed to rent multiple devices.
- By renting a device for heating tobacco products, you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions, you are not allowed to rent products from Philip Morris.
- You hereby warrant that (i) your provided contact details are valid and correct and (ii) that the payment method provided is (and will remain) valid and have sufficient funds for any amount due with reference to this rental agreement.
- By completing this order process and selecting an available device, you rent one (1) device for 21 days (Rental Period) for a rental fee of 49 DKK (Rental Fee).
- When the order process is completed, you will receive an order confirmation with a specification of the products rented and detailed information concerning the price, terms of payment, return policy and shipping costs. You will also receive a link in the order confirmation to these terms and conditions. If you notice any incorrect data in the order confirmation, please notify us without undue delay.
- The Rental Fee will be charged to the payment method you select in the order process. Please be advised that the payment methods offered for our device rentals are provided by third party payment service providers and that use of such third-party payment services are subject to such payment service providers terms of use. Please ensure that you understand and agree to all applicable terms and conditions for use of the selected payment service prior to using such third-party payment services.
- All fees are given inclusive of VAT and other applicable sales taxes. Any additional cost or expense will be clearly indicated prior to check-out and your placement of a rental order.
- After the expiration of the 21-day Rental Period, you can either choose to return the rental device or purchase the rental device for an amount of 250 DKK (ILUMA ONE) or 450 DKK (ILUMA).
- If you decide to return the device after the Rental Period, you can return it free of charge through PostNord by using the included bag and return label.
- If you decide to keep the device, you can at any time during the rental period complete the purchase process at a link received in the order confirmation. For purchase terms, see Terms of use. Please be aware that the 60-day money-back guarantee is not applicable for purchased rented products.
- Philip Morris ApS does not charge anything for normal wear and tear caused to the rental device during the Rental Period. If your Device suffers [accidental and unintended damage] that affects the functionality of your Device which is not caused by your misuse or reckless behavior (Accidental Damage) you may be eligible for a replacement Device.
- Unless you purchase the rental device, Philip Morris retains full ownership of the rental device (including the included accessories).
- You acknowledge and agree that you are solely responsible for any lost or unreturned rental equipment. Unless you purchase the rental device as set forth herein, you must return the rental device promptly at the expiration of the Rental Period.
- Should you fail to return the rental device together with the included accessories;

- within 7 days (28 days total) from the expiration of the rental period (provided that you have not already completed the purchase process), you must pay 250 DKK (ILUMA ONE) or 450 DKK (ILUMA) for the unreturned rental equipment. Please note that this amount will automatically be charged to the payment method you provided when renting the device.
- Philip Morris reserves the right to change the content of these rental terms at any time. For the avoidance of doubt, such changes will not affect any rental agreement concluded prior to the effective date of new or amended terms and conditions.

- You hereby confirm that you have received information regarding our processing of your personal data, which is available at IQOS Privacy Policy.
- These Terms are governed by the laws of Denmark and disputes will be finally resolved by the courts of Denmark.
- If you are not satisfied, you may also refer a dispute to Center for Klageløsning, Nævnenes Hus, Toldboden 2, 8800 Viborg, provided that the requirements for submitting a claim are fulfilled. You may submit a claim to Center for Klageløsning at www.forbrug.dk.
